Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PixRestorer website and AI-powered photo restoration, colorization, and upscaling services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

You must have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. The Service is not intended for children under 13.

2. Service Description

PixRestorer provides AI-assisted tools for restoring, enhancing, colorizing, and upscaling user-provided photographs. We use Replicate as our inference platform. Restore and colorize requests are processed with the Replicate-hosted flux-kontext-apps/restore-image model, which is powered by FLUX.1 Kontext, an image-editing model developed by Black Forest Labs. Upscale requests are processed with the Replicate-hosted nightmareai/real-esrgan model, an implementation of Real-ESRGAN, the open-source super-resolution model originally developed by Tencent ARC. Model names, versions, and behavior may change as the Service is improved.

AI results are generated automatically and may be inaccurate, incomplete, or different from your expectations. You are responsible for reviewing results before relying on or sharing them.

3. Accounts and User Responsibilities

  • You are responsible for providing accurate account information and keeping your credentials secure.
  • You must have the rights and permissions needed to upload and process every image you submit.
  • You may not share access to your account, bypass usage limits, or use the Service for unlawful purposes.
  • You are responsible for all activity performed through your account.

4. Credits and Purchases

The Service uses credits. You may purchase one-time credit packs through the pricing page at pixrestorer.com/pricing. The number of credits included in a pack and its price are shown before you confirm the purchase. Credits are consumed when an eligible processing request is submitted.

Credits are not cash, are not transferable, and cannot be redeemed for money except where a refund is required under Section 7 or applicable law. Free, promotional, or bonus credits may be subject to additional restrictions stated when they are granted.

5. Billing and Payment

Each credit-pack purchase is a one-time transaction. By confirming a purchase, you authorize the payment amount displayed at checkout. Prices may exclude applicable taxes unless the checkout states otherwise.

Payments are processed by Creem, our third-party payment processor and merchant-of-record where applicable. Creem may apply its own payment, tax, and billing terms. PixRestorer does not store your full payment-card number on its servers.

We do not currently promise automatic top-ups or recurring charges for credit packs. If a future feature introduces recurring billing, its authorization and cancellation terms will be shown before enrollment.

6. Credit Use and Account Termination

Credits are available while your account remains active, unless an expiration date or other restriction is clearly shown at the time of purchase. If your account is terminated for a violation of these Terms, unused promotional credits may be forfeited. Any treatment of purchased credits on termination is subject to applicable law.

When a processing job fails because of a service or model error after credits have been deducted, we will return the deducted credits to your account where our systems support that automatic recovery. A returned credit is not a cash refund.

7. Refund Policy

Used credits and successfully completed processing are generally non-refundable. We may approve a refund to the original payment method in the following cases:

  • Unused credits: You request a refund within 7 days of purchase and none of the purchased credits have been used.
  • Duplicate charge: The same transaction was charged more than once because of a billing error.
  • Verified technical or payment error: A charge was taken but the purchased credits were not delivered, or a service failure prevented the purchased transaction from being fulfilled and an in-account credit return is not possible.
  • Legal rights: You retain any non-waivable refund, withdrawal, or consumer rights provided by the laws that apply to you.

To request a refund, email support@pixrestorer.com with your account email, transaction or order ID, purchase date, and a description of the issue. We will acknowledge a complete request within 2 business days. After approval, we generally submit the refund within 5–10 business days; your bank or payment provider may take additional time to post it.

Refunds are not available for credits already consumed by successful processing, free or promotional credits, dissatisfaction with a result after use, requests made outside the stated period, or abuse, fraud, or chargeback misuse, except where applicable law requires otherwise. We may request reasonable information to verify a request.

8. Billing Disputes

Please contact support@pixrestorer.com before initiating a payment dispute so we can investigate missing credits, duplicate charges, or other billing errors. Nothing in this section limits your rights under applicable payment or consumer-protection laws.

9. AI Content and Intellectual Property

You retain ownership of images you upload, subject to the rights of other people or entities in those images. You grant PixRestorer and its service providers a limited, non-exclusive license to access, transmit, and process your images only as needed to provide, secure, and support the Service.

PixRestorer owns the Service, its software, branding, and underlying technology. Subject to these Terms, you may use results generated from your authorized inputs for lawful purposes. You are responsible for checking whether your use of an output infringes another person's rights.

10. Acceptable Use

You must comply with the Acceptable Use Policy, which is part of these Terms. You may not upload, generate, or process content that is illegal, harmful, abusive, or infringes another person's rights, or attempt to evade our safety measures.

11. Data, Privacy, and Security

Our Privacy Policyexplains how we collect, use, and share information. Images are sent to Replicate for processing and are not intended to be stored on PixRestorer's own servers after processing. Third-party providers may process data under their own terms and privacy policies. No internet transmission or storage method can be guaranteed completely secure.

12. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. PIXRESTORER DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI RESULTS WILL BE ACCURATE OR SUITABLE FOR A PARTICULAR PURPOSE.

AI results are not professional, legal, medical, financial, or other expert advice. You must obtain appropriate professional advice where needed. To the maximum extent permitted by law, PixRestorer will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded.

13. Term and Termination

You may stop using the Service at any time. We may suspend or terminate access, refuse a request, or remove content when reasonably necessary to protect the Service, enforce these Terms, prevent fraud or abuse, or comply with law. Termination does not remove obligations that by their nature should continue, including payment disputes, intellectual property, disclaimers, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable to PixRestorer and the transaction, without regard to conflict-of-law rules. Before bringing a formal claim, the parties should first try in good faith to resolve the dispute by contacting support@pixrestorer.com. This does not limit any mandatory consumer or statutory dispute-resolution rights.

15. General Provisions

If a provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Acceptable Use Policy, are the entire agreement concerning the Service. We may make material changes by posting updated Terms and, where required, giving reasonable notice before they take effect. The updated date identifies the current version.
